According to court records, Athens-Clarke County Solicitor General Will Fleener filed a motion to dismiss the charges on August 6 and Judge Charles Auslander III approved the motion the next day.
“After a careful review of the evidence, including footage from downtown cameras, it is clear the State will not be able to prove Reckless Driving beyond a reasonable doubt,” Fleener said, who dismissed a second citation “in the interest of justice.”
He did write about this and ensured that the article mentioned the “9th such arrest” of this year, so there’s that.
While this certainly doesn’t excuse anyone for reckless behavior or the continuing issues with racing, it might shed some light as to why Sacovie’s bail was only $26? Perhaps it wasn’t as big of a deal, maybe the ACC actually targets Georgia football players, or something else? Who knows…anyone out there with legal insight (I know there are some) care to shed some light?
$26 back!? They towed his car which ain’t free AND the arresting officer lectured him in the paper! I don’t pay my taxes for police lectures. Thankfully, I started speaking Spanish and stopped wearing UGA gear so Athens Police don’t bother me during my crime sprees.
Furthermore, why is White named multiple times in the article but the arresting officer’s name is left out? Is a freeborn, innocent until proven guilty American not afforded any privacy when being targeted by police? Was Classic City Serpico some kind of secret agent? Do we just blow off false arrests and stealing people’s vehicles to fund the Parking/Towing Industrial Complex because something, something public safety? That apparently wasn’t the case since the charges couldn’t be proven (with the surveillance footage not showing the charges as legit, btw)…
