This post is written before any verdict has come down and whatever the jury does, or doesn’t do, is not going to change the law or reality one iota. Pushing past the question of causation, which no layman can fairly ascertain on their own, the fact is that self-defense law is consistent across every state in America in that you can’t legally kill a person who you are not in fear of at the time of you cause the death, period. That you were once afraid or may become afraid in the future is not important. What is important are the state of things at the time of death.
The only question, should the jury find that the defendant’s actions resulted in death, is: was he reckless or negligent when committing the acts that caused death? That question will make the difference between the felony and the misdemeanor.
Acquittal is just not a possibility under the law where an intentional act leads to an asphyxiation. It just isn’t. Reason being is that if you can gain the sort of physical control necessary to deprive a person of oxygen there is little doubt that you can gain sufficient control in a manner that does not also deprive the person of oxygen. Pretty simple and straightforward.
Theoretically, the defendant could have punched the person in the head sufficient to cause death IF that punch was thrown at a time when acting in self-defense, or defense of others, was appropriate. Here, the chosen method used to subdue the person permitted the risk of harm to extend well past the point where any reasonable fear remained.
In short, if a liquor store owner is held up at gun point, successfully disarms the robber, and then garrotes the robber to death or stabs him 87 times with a pocket knife, self-defense isn’t going to fly, no matter how many drugs the robber was on, the length and scope of his criminal record, his mental health or medical history. Likewise, a narrative that he beat my sister, repeatedly, and admitted to conspiring, along with the same people who had may father shot, to having my brother shot on the Causeway, so I had him killed is not a defense here.
Nor were the memorable subsequent events an appropriate or legal means to prevent a coup de grace in your place of business.
To be clear, I have no problem with the defense attacking causation or trying to get the jury to ignore the law. The right to a jury trial is diminished if juries can’t apply their own sense of right and wrong under the circumstances presented. If the jury hangs or finds the guy not guilty, I really don’t care. If I didn’t trust the judge to impose a reasonable sentence, I might vote to acquit myself. The guy doesn’t deserve jail time no matter what the law says about guilt. You can act with noble intentions and also break the law. A suspended sentence makes perfect sense here should a guilty verdict come in.
What annoys me is the failure of the article to state all of the actual facts, or the law and the victimhood narrative the article choses to embrace. Why can’t the article note that while the deceased was loud and boisterous and frightening, he had not touched a soul? Why doesn’t the article note that the deceased’s single possession on his person was not a knife or gun or club, but instead was a muffin?
Why does the person in the attached video bitch about “blue states” while living in the bluest of “blue states” and one he is to be sworn into elected office next month? The comparison to an armed terrorist is a bit rich ain’t it?
And not every deep state blue state offical is calling for blood here.
I would never suggest that race or politics play no role in these things, it does. Far too often, sadly. In general, the biases go the other way, including in “blue states.” Typically, this particular “news” outlet seeks to diminish and mock the role race may play in police and prosecutorial decision-making. Here, for some reason, it just recklessly pours gasoline on things. Why? To what end? What possible good could come from making its customers less informed and angrier and more divisive?

One word answer, chaos. As long as the populace is kept in a state of fear about “the other,” the economy, their job security, electric cars or A.I., the “strong leaders” and the people who benefit from the will of the demagogues will continue to promote chaos. What strikes me the most about the story, outside of the mayor’s statement that the marine “did what the state should have done,”(kill a homeless mentally disturbed man?) was that the Marine came back in country with a heightened sense of how “problems” are to be resolved. Maybe he thought he was on The 15:17 to Paris and that he would be hailed as a hero by taking down a “terrorist on a train. Who knows?
There are probably many who would side with that point of view. A Gallup poll states that 40% of Americans are afraid to walk a mile from their house at night. Gentrification is not working as well as expected. When one political party runs two commercials ad infinitum before the election directed at stoking the fear “of being able to survive making it through the night,” or hysterically, a full-grown man joining a girl’s U14 basketball team, then it’s all about the fear, the chaos.
We are being taught to not trust our instincts, our humanity, our courts or even our religious teaching because there is but one solution, and “I alone can fix it.” Not even Jesus would take on that load and He at least had help from above. He didn’t sell the words of His Father for a cool grand, so maybe He was just another “loser.”
The only thing we have to fear is…not being scared shitless!!

You are correct, and at least one of those you are conversing with has been provably shilling those same opinions for years. The world is an absolute mess, too many examples to name, many of which have exponentially increased in the last several years due to pitifully poor policy. It’s insanity to allow a man to participate in women’s sports, even crazier to allow them access to women’s spaces, especially men with what should be considered a mental illness, in the form of gender dysphoria. Illegal immigration is a problem that will deteriorate pur countries values, resources, and identity, until it’s so far from what we have now, we won’t even recognize it anymore. We are the majority, because they overplayed their hand, and now we have all three branches of government, the Supreme Court majority, and the support of most (feels so, so good saying that..) of the country.
